Can an Agency Run MVRs? Can They Reveal That Information to the Insured?
Question: “Can an agency run MVRs? If we do run an MVR or receive information on a driver, can we give that out to the insured?”
Answer: It is permissible for an insurance agent to order MVRs for insurance underwriting or rating purposes. Sharing them, however, is another matter. Essentially, if you share MVRs, you could fall within the Fair Credit Reporting Act’s definition of “credit reporting agency”. You also might be in violation of your user agreement with the vendor from whom you get the MVRs. I recommend that you review the following pieces carefully:
