NY Workers’ Comp Board Sets New Min, Max Weekly Benefits
The New York State Workers’ Compensation Board has announced the minimum and maximum weekly disability benefit rates for the coming year.
State law requires the board to calculate these rates annually based on the New York State Average Weekly Wage (NYSAWW) for the prior calendar year. The changes take effect on July 1 each year. The formulas are:
- Maximum Weekly Benefit = two-thirds of the NYSAWW.
- Minimum Weekly Benefit = one-fifth of the NYSAWW or the employee’s actual wages, whichever is less.
According to the state Department of Labor, the NYSAWW for calendar year 2025 was $1,922.25. Consequently, the new rates are:
- Maximum Weekly Benefit = $1,281.50
- Minimum Weekly Benefit = $384.45
The rates apply to compensable lost time for workers’ compensation claims with dates of injury during the period from July 1, 2026, through June 30, 2027.
