The Biggest Show of Our Educational Year Just Got Bigger
It is already March, which means the annual IIABNY E&O loss control seminars are fast approaching! Before we draw any closer, I want to make sure all IIABNY members are aware of a new option to view the 2017 Annual IIABNY E&O loss control videoconference.

Kathy LawlerFor the past several years, members across the state have asked for the option to view the E&O loss control videoconference, presented by attorneys Jim Keidel and Chris Weldon, in their own office rather than travel to a common location, such as a local college or hotel. The technology we currently use will allow us to do just that. So, we are offering the webinar option for the first time on June 7. This development means each member in every part of the state will have the ability to view the videoconference live on their computer or tablet. And, they’ll still have the opportunity to earn four continuing education credits for all licenses and receive our discount for purchasing their E&O insurance through IAAC.

We are continuing the “live” classroom-style seminars in five locations during the month of May, as well as the June 7 videoconference simulcast to 10 locations. By adding the webinar option, all members will be able to access this valuable E&O loss control information. This year during the seminar, Keidel, Weldon and IAAC President Brian Bixby will cover the following:

  • relevant laws affecting property and casualty and life and health insurance agents and brokers
  • New York's new cybersecurity regulation and how to comply
  • the most common agent and broker issues involving the New York State Department of Financial Services
  • handling a DFS inquiry
  • common types of E&O claims and lawsuits asserted against New York agents and brokers
  • Best practices for documentation
  • agency mergers and acquisitions

State Insurance Fund Hosts 1st Producer Advisory Council Meeting
An historic event of sorts took place Feb. 1 at the New York City office of the State Insurance Fund. NYSIF staff, led by executive director Eric Madoff, welcomed members of the fund’s first Producer Advisory Council for an exchange of ideas. NYSIF staff provided a demonstration of the fund’s new website and discussed new procedures for underwriting, premium audits and claims.  IIABNY has been busy developing and strengthening its relationship with NYSIF for the past several years and recognizes this meeting as a major step forward in the evolving relationship between producers and the State Fund.

NYSIF established the council for the purpose of obtaining guidance and reaction to the fund’s practices that impact producers. While the council does not have any governance or policy authority, it serves as an important link between the fund and producer community.

Seven agents were selected to serve on the council through recommendations submitted by IIABNY and Professional Insurance Agents of New York. They are: IIABNY Chair of the Board Jack Smith of William A. Smith & Son in Newburgh; John Costello of Key Insurance & Benefits Services in Rochester and an at-large member of the IIABA executive committee; Valerie Geasor of Signature B&B Companies; Fred Holender of Lawley Services; Gene Sandy of Millennium Alliance Group; Justin Fries of Garber Atlas Fries & Associates; and John Tomassi of The Winfield Group. They will meet periodically on a scheduled established by NYSIF.

This Week in Albany - IIABNY Worker's Compensation Bill is Introduced
A bill IIABNY developed, requiring workers' compensation carriers to provide a 30-day notice when a renewal premium offered by an affiliate raises the premium more than 10 percent, has been introduced in the State Senate. S.1005 is sponsored by Sen. Joseph Robach (R-Rochester).

Assemblyman Andrew Hevesi (D-Queens) is expected to introduce companion legislation soon in his house. The bill passed the Assembly last year but did not receive a vote in the Senate. IIABNY will work to pass the legislation this year in both houses of the State Legislature.

Our Wish for the New Year: Improve NY’s Proposed Cybersecurity Regulations
New York’s legislature will get a chance to hear about the flaws IIABNY finds in the state Department of Financial Services’ proposed cybersecurity regulations. The Assembly Banking Committee will hold a hearing on Dec. 19 in Albany to hear public testimony on the regulation that would require banks and other financial institutions in the state, as well as insurers and insurance agencies and brokerages, to establish and maintain a cybersecurity program. IIABNY intends to submit testimony at the hearing, outlining the association’s concerns.

As we previously reported, IIABNY has already submitted comments to the DFS during its 45-day comment period that began in September. The association is concerned about the high cost of complying with the proposed requirements. Some may cost more than $100,000 to meet. Two-thirds of IIABNY member agencies have fewer than seven employees, and they cannot afford these costs and could be forced to close.

In the comment letter submitted to the department, IIABNY proposed a set of specific recommendations, including exempting additional small agencies from the requirements and expanding the regulation’s 180-day implementation period. A response to all comments is expected from the DFS before the regulations go into effect on Jan. 1, 2017.

IIABNY is hopeful the DFS and/or state lawmakers will recognize the proposal’s major shortcomings. Our wish for the New Year is that the necessary revisions will be made to prevent another costly and onerous mandate from jeopardizing our members’ operations and the prosperity of our state’s economy. We’ll certainly do everything we can to forestall such a monstrous regulatory misstep.

Some Buzz Over Proposed Cyber Security Regulation is Plain Wrong
Since the state Department of Financial Services proposed new cyber security regulations in September, IIABNY has found the facts surrounding the proposal have been misstated by some, raising agent concerns. For example, some believe the regulation has already taken effect when in fact, we are in a 45-day comment period the DFS launched Sept. 28 when it published the proposed regulation in the State Register.

While IIABNY has many concerns about the regulatory proposal and is in the midst of preparing our formal comments for the DFS to consider, we would like to correct several misunderstandings. In the latest post of our Advocacy Buzz blog, IIABNY Senior Vice President of Industry Relations Kathy Weinheimer provides an update that focuses on two key areas — limited exemptions for small businesses and a provision involving third parties.

Kathy Glahn is currently the longest-serving active employee on IIABNY's payroll. The assistant vice president of information systems oberved this week 35 years of service to IIABNY members. Glahn, who has served in a variety of positions for the association, was toasted this week by her co-workers for her long tenure at IIABNY.

IIABNY Board Tackles NYS Cybersecurity Proposal, Discusses 'P2P' Insurer 
A cybersecurity regulation proposed by the state Department of Financial Services drew plenty of attention at this week's meeting of the IIABNY board of directors. The association's elected leaders heard agent concerns over the regulation's requirements and their potential impact on agents and brokers.
          
The board also reviewed the entry of a so-called peer-to-peer insurer in the New York market, completed action on a bylaws amendment adjusting a membership requirement and discussed two national market trends that could eventually affect New York.

Reprising ‘College and Coverage: What Could Go Wrong?’
Your client’s children are back on campus enrolled in business administration or, better yet, risk management classes. Whether they’re living in a residence hall on campus or sharing an apartment off-campus with a couple of buddies, you as their agent or broker have an opportunity to make sure they’re properly protected away from your client’s home.

Now is the time to review their coverage and have a conversation with your clients before going later into the school year and being left high and dry after thieves steal that awesome (awfully expensive) laptop computer. Finding out the kids could have been covered but were not is likely to substantially lower your esteem in the eyes of your client. You might also miss out on a sales opportunity, too.

How We See It
7 Things You Can Do to Help Your Business During Dog Days of Summer
Summer imageWe hope you are basking in or already took the opportunity to join in the joys of a summer vacation. If you haven’t, please plan to take some time off before autumn draws near. Stepping away from your normal work routine and relaxing for a few days or a week or two, according to the experts, can recharge your creative juices and bring clear benefits to your agency or brokerage. In the meantime, if you’re in the office, this too can be one of the most productive times of the year.

Here are a few things you can do now to prepare for the fall and the remainder of the year:

  1. Establish one goal for internet marketing to be completed by the end of the year. TrustedChoice.com can help.
  2. Review staff continuing education progress, looking for those renewing their license soon but are missing the required credit hours. IIABNY can provide a list of credits for courses completed through the association. 
  3. Review IIABNY's new web-based, interactive training program and identify staff who could benefit from it.
  4. Develop a list of insurance issues for parents of college-bound children. Post the list on your blog or agency website.
  5. Review and evaluate your agency year-to-date growth. Choose one personal and/or commercial growth objective to concentrate on for the remainder of the year.
  6. Develop a list of FAQs (Frequently Asked Questions) and the answers, then post on your agency website.
  7. Update your emergency communications plan using social media. IIABNY has useful tips.
Now that we think about it, there are probably plenty more things you can do this summer outside of water skiing, swimming, fishing, traversing the links and firing up the barbecue grill. With those creative juices overflowing because you took a vacation, let us hear from you with your ideas.

NYSIF Debuts Electronic Apps for Brokers After IIABNY Encouragement
Today, the New York State Insurance Fund announced an electronic application for insurance brokers, allowing producers the ability to complete applications on behalf of their clients while allowing clients to use DocuSign technology for digitally signing and paying premium deposits online. This capability allows for a complete online application process, which is a major improvement over the prior process of printing the electronic application and mailing it with a payment.

The online application and payment option have been available to employers writing directly with NYSIF since October 2015. This latest announcement broadens that availability to brokers working on behalf of their clients. The service will also soon be available for Safety Group accounts.

The announcement follows a series of meetings between IIABNY and NYSIF over the last two years in which NYSIF has embraced the concept of what brokers bring to the table. The State Fund has worked with IIABNY to focus on process improvements for our mutual clients.

Recruit Millennials During Insurance Careers Month
This February, InVEST® joins insurance carriers, trade associations and industry partners to invite the insurance community to support the first-ever Insurance Careers Month. The goal is to inspire young people to choose insurance as a career, share what makes the industry a great one to work in and collaborate and share best practices. We’re getting the word out that insurance offers some of the most rewarding careers out there. It hits the career trifecta — stable, rewarding and limitless.

The gathering talent shortage is a perfect storm of sorts with more than 60 percent of the industry’s employees retiring in the next seven years. In New York, for example, nearly one-third of agency principals are over 65 years old, according to information culled from the 2014 Agency Universe Study. Additionally,400,000 positions are expected to become open nationwide by 2020. The pipeline for talent isn’t exactly running at full throttle at the moment, either. Only 80 academic programs offering courses in risk management and insurance are located in the U.S. Their graduates are expected to fill less than a quarter of the industry’s future job openings.

The talent gap isn’t limited to the U.S. and that’s why Insurance Careers Month is an international effort. In fact, the campaign was not only launched in the U.S. with InVEST on Monday, the insurance industry in the United Kingdom and Bermuda has also joined the effort. IIABNY and IIABA are asking their member agencies to do their part by targeting and recruiting millennials during the month.
